1. Introduction

Chapter & Joy (“we,” “us,” or “our”) operates a platform that lets you create personalized, AI-illustrated books for children and families. These Terms & Conditions (“Terms”) govern your access to and use of our website, mobile application, and all related services (collectively, the “Service”).

By creating an account or using any part of the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

By using the Service, you represent and warrant that you meet these eligibility requirements.

3. Your Account

When you register for an account you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

If you suspect unauthorized access to your account, notify us immediately at help@chapterjoy.com. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been compromised.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in compliance with these Terms. Without limitation, you shall not:

• Use automated scripts, bots, or crawlers to access or interact with the Service without our prior written consent.
• Upload, submit, or generate content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable.
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service or its underlying technology.
• Resell, redistribute, or commercially exploit Service output on a mass or automated basis without our express authorization.
• Interfere with or disrupt the integrity or performance of the Service, including by introducing viruses or malicious code.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

We reserve the right to investigate and take appropriate action — including suspending or terminating your account — if we believe you have violated these restrictions.

5. Purchases, Payments & Refunds

5.1 Token Purchases

Certain features of the Service — such as generating AI illustrations and creating books — require tokens. Tokens are purchased as one-time transactions and are added to your account balance upon successful payment. Tokens have no cash value, are non-transferable, and cannot be exchanged or redeemed for currency.

5.2 Physical Book Orders

You may order printed copies of books you have created through the Service. Physical book orders are fulfilled by a third-party printing partner. Shipping times, costs, and availability may vary depending on your location and the shipping option you select. Once a print order has been submitted to our fulfillment partner, it cannot be modified or cancelled.

5.3 Payment Processing

All payments are processed through Stripe, a third-party payment processor. By making a purchase you agree to Stripe's terms of service. We do not store your full payment card details on our servers.

5.4 Pricing

We reserve the right to change prices for tokens, printed books, or any other paid features at any time. Price changes will not affect orders that have already been completed.

5.5 Refunds

Because digital tokens are consumed immediately upon use, token purchases are generally non-refundable. For physical book orders, if you receive a product with a significant manufacturing defect, please contact us at help@chapterjoy.com within 30 days of delivery and we will evaluate a replacement or refund on a case-by-case basis. Refunds for other circumstances are granted at our sole discretion.

6. User Content

“User Content” means any text, images, photographs, prompts, character descriptions, or other materials you upload, submit, or create through the Service.

6.1 Ownership

You retain ownership of the User Content you provide. We do not claim ownership over your original photos, text, or other inputs.

6.2 License to Chapter & Joy

By submitting User Content, you grant Chapter & Joy a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, process, and display your User Content as necessary to operate, provide, improve, and develop the Service — including training and improving our AI models. This license survives termination of your account to the extent the content has been incorporated into aggregated or anonymized datasets.

6.3 Content Standards

You represent that you have all necessary rights to submit your User Content and that it does not violate any third party's intellectual property, privacy, or other rights. We reserve the right to remove or disable access to any User Content that violates these Terms or that we find objectionable, without prior notice.

7. AI-Generated Content

The Service uses artificial intelligence to generate illustrations, stories, and other creative outputs (“AI-Generated Content”). You acknowledge and agree that:

• AI-Generated Content is provided on an “as is” basis and may contain inaccuracies, unexpected results, or artifacts.
• We do not guarantee that AI-Generated Content will meet your expectations, be free from errors, or be suitable for any particular purpose.
• You are solely responsible for reviewing all AI-Generated Content before sharing, publishing, or printing it.
• AI-Generated Content may resemble existing works due to the nature of machine-learning models. We make no representations regarding the uniqueness of any output.

8. Intellectual Property

The Service — including its design, software, text, graphics, logos, and trademarks — is owned by or licensed to Chapter & Joy and is protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service or our intellectual property beyond the limited right to use the Service in accordance with these Terms.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and share your information. By using the Service, you acknowledge that you have read and understood the Privacy Policy.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service at our sole discretion, without prior notice, if we believe you have violated these Terms or for any other reason we deem appropriate.

Upon termination, your right to use the Service ceases immediately. Any unused tokens remaining in your account at the time of termination are forfeited and will not be refunded. Sections of these Terms that by their nature should survive termination — including ownership, disclaimers, and limitations of liability — will continue to apply.

11. Disclaimers & Limitation of Liability

11.1 Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.

11.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CHAPTER & JOY, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING UNDER OR RELATED TO THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-law principles. You agree to submit to the personal jurisdiction of the state and federal courts located in Delaware for the resolution of any disputes arising out of or relating to these Terms or the Service.

13. Changes to These Terms

We may revise these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top of this page and, where appropriate, notify you through the Service or by email. Your continued use of the Service after revised Terms take effect constitutes your acceptance of those changes. If you do not agree to the updated Terms, you should stop using the Service.
